PERIZIE DI CONFORMITA' - SICUREZZA MACCHINE ANTE 1996

Come faccio ad acquistare una macchina non certificabile in Direttiva Macchine (2006/42/CE) poichè ante 1996 (anno dell'entrata in vigore del DPR 459/1996 e dell'attuazione della prima Direttiva Macchine 89/392/CEE)?
In tali casi il venditore della macchina, o l'importatore nel caso si tratti di macchina usata extra UE, devono fornire le perizie di conformità macchinario (Art.11 comma 1-D.P.R. 459/1996), che attestano l'avvenuta analisi e la conformità della macchina in termini di sicurezza sotto vari aspetti.
Un'indagine in merito alla sicurezza della macchina, svolta in maniera approfondita, produce una perizia idonea se e solo se la macchina è idonea. Diversamente si tratta di "messa in ordine apparente" solo ai fini della vendita, attività caldamente sconsigliata.
In ogni caso: la perizia non esonera il direttore di stabilimento a verificare la reale conformità in fase postuma, e per questo occorre il ruolo svolto dal consulente che assicuri la validità della stessa perizia e/o fornisca delle indicazioni al fine di rendere sicura la macchina ai sensi:

In such cases, the vendor of the machine, or the importer in the case of an extra UE machine, must provide the machine conformity reports (Art.11 paragraph 1-DPR 459/1996), which certify the analysis and the conformity of the machine in terms of safety in various aspects.
An investigation of the safety of the machine, carried out in depth, produces a suitable expertise only if the machine is suitable. Otherwise it is "apparent ordering" only for the purpose of sale, activity strongly discouraged.
In any case: the appraisal does not exonerate the plant manager to verify the actual conformity in the posthumous phase, and for this it is necessary the role of the consultant who assures the validity of the same appraisal and / or provides indications in order to make the machine safe under specified rules.
